Rape

Since Wisconsin codified its criminal laws, the common law term "rape" has been replaced by the term "sexual assault". As was true for the crime of rape, a sexual assault can include sexual intercourse with an adult or a minor child. Beyond the terms provided in the common law crime of rape, a sexual assault includes any contact that is of a sexual nature.

Violent Rape

Under Wisconsin law, a sexual assault involving any form of violent act such as force or threat or use of a deadly weapon increases the charge from a sexual assault to a sexual assault with battery.

Felony Crime

Any sexual assault crime in the state of Wisconsin involving a minor is a felony.

Misdemeanor Crime

Sexual assault of a minor over the age provided by law is a misdemeanor offense unless the sexual assault involved any form of violence.
