Sexual assault offenses under Wisconsin law range from misdemeanor offenses to felony offenses with very long prison sentences.
Definition of sexual assault
First degree sexual assault is defined under Wisconsin law as the sexual contact or intercourse with a person without consent and causing great bodily harm, or by use or threat of use of a dangerous weapon, or the aiding of a sexual assault upon a person, or the sexual assault or sexual contact of a minor child.
First degree sexual assault is a Class B Felony subject to 60 years in prison.
Second degree sexual assault is defined under Wisconsin law as sexual contact or intercourse with another person without consent by use or threat of use of force or violence, or by causing injury or illness, or with a person who is drunk or unconscious, or with a person who has limited mental capacities, or as a gang rape.
Second degree sexual assault is a Class C Felony subject to fines up to $100,000, 40 years in prison, or both.
Third degree sexual assault is defined by Wisconsin law as intercourse with a person without consent, as intentional ejaculation, urination or defecation upon another person's body with an intent to degrade or humiliate that person or bring gratification or arouse the actor.
Third degree sexual assault is a Class G Felony subject to fines up to $25,000, 10 years in prison, or both.
4th degree sexual assault
Fourth degree sexual assault is defined under Wisconsin law as nonconsensual sexual contact with another person (often referred to as molestation or fondling).
Fourth degree sexual assault is a Class A Misdemeanor subject to fines up to $10,000, or nine months in jail, or both.
